The Role of the County Prosecuting Attorney
The county prosecuting attorney, along with the county sheriff, is the chief law enforcement officer in the county (31-2227). The prosecutor is ultimately responsible for all felony cases within a county. In addition, the prosecuting attorney is the chief legal advisor to the county (31-2604 and 31-2607). The prosecuting attorney is required to be a licensed Idaho attorney and is elected for a term of four years. However, if no person is available to hold office within a county, the law gives the board of county commissioners the authority to contract for the position (59-907).
